DMCA Policy

As a game server hosting provider, we respect the intellectual property rights of others and expect our users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for reporting alleged copyright infringement and for submitting counter-notifications regarding content hosted on our servers.

We comply with the provisions of the DMCA (17 U.S.C. ยง 512). Our policy is to respond to clear notices of alleged copyright infringement that comply with the DMCA and to take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Filing a Copyright Infringement Notification

If you believe that material hosted on our game servers infringes your copyright, you may submit a copyright infringement notification to our Designated Copyright Agent. To be effective, the notification must be a written communication that includes substantially the following:

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g., game server IP address, server name, specific file paths, or URLs).
  3. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the infringing material and notify the subscriber responsible for the material.

Filing a Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. To be effective, the counter-notification must be a written communication that includes substantially the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., game server IP address, server name, specific file paths, or URLs).
  • A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • The subscriber's name, address, and telephone number.
  • A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • A physical or electronic signature of the subscriber.

Upon receipt of a valid counter-notification, we will send a copy of the counter-notification to the original complaining party. If the complaining party does not inform us within 10 business days that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system, we may replace the removed material or cease disabling access to it.
